Hi Terry I was wondering I have a house that’s basically been in foreclosure for six months now I have a few hardships I was hit by a drunk driver which left me unable to work and I’m still fighting for social security meanwhile my house is in foreclosure I go in February this is an Illinois does this new bill that passed affect my foreclosure I want to stay in my house and I’m wondering do I start paying my house payments before I go back to court or wait does this foreclosure automatically stop mine or delay it I’m wondering if you recommend me to start paying my payments and just get it out of foreclosure or just wait just wondering what your thoughts were my original house payment was $866 they raised it to $1,192 because of back payments and fees which is no problem I can pay that but again I’m wondering do I start paying it or go to court in February and continue it again just wondering what your thoughts were on this thanks for all your help it’s always great to talk to you thank you

It depends on the type of mortgage you have as to when foreclosure will be “allowed” again. But you can be sure that when you go to court, you will be required to pay the ENTIRE back mortgage payments, plus interest and penalties. Do you have enough money for that?
What you need is a good lawyer who can represent you and try to negotiate a deal with the lender BEFORE this goes to foreclosure court — So start NOW! Call the National Foundation for Credit Counseling at 800-388-2227 for a lead on such a lawyer or go to legal aid in Chicago at (312) 332-1624. If you do have some money and a good lawyer you might be able to strike a deal NOW, while banks want to solve these problems.
But just paying “some money’ on your arrearage will get you nowhere!
