Ask Terry Questions Taxes for decedent

Taxes for decedent

By Terry Savage on July 07, 2022 | Social Security

My mom passed 3/2020. We paid her 2019 taxes late after we finalized everything. I just received a letter from the IRS in her name c/o me with late charges. How do I dispute? Am I liable?

Did you use an attorney to close the estate? He/she should respond to the IRS saying the estate is closed and has no assets to pay the penalty. That should take care of it — since technically she — or her estate — owed the taxes. If you were the executor or successor trustee they might try to get the money from you, but this should be a pretty good defense. As the attorney to stop in and contact the IRS.
