I have not heard from Social Security about receiving my husbands social security from the Fairness Act Distribution Windfall elimination. My husband passed away December 7, 2019 and I applied for Social Security and was denied because I receive a federal pension. I have called six (6) times on separate occasions and can not get through. No calls back . When I call the local Social Security Office it tells you to call the 1-800-772-1213 number which is what I have been doing. Any suggestions or do I just wait. Thank you! Are you receiving any benefits on your own account? If so, the monthly payment should have been increased because of the Fairness Act.

If you are not eligible for benefits on your own record, you are definitely eligible for HIS unreduced benefit now.
BUT you must start over and apply for your widows benefit. Since you were not receiving it before, you won’t get the one-time catch-up payment. But you should get your widows benefit.
