Ask Terry Questions Ex husband IL income tax

Ex husband IL income tax

By Terry Savage on April 06, 2026 | Wild Card

My ex husband and I would file our taxes jointly and 2020 filing was the last time we filed together. In 2020 he left the country and didn’t come back. So in 2021 I filed it as head of household and by myself and my children. Now I am getting IL dept of revenue that he owes 2021 taxes that were not filed. Am I responsible to pay that or can they come after me to pay them? It was $500 at 1st but with interest it is $1099.00.

This is where you will likely need a tax attorney. But first, contact the Illinois Department of Revenue (the number on the letter you received) and tell them of your situation. Get a certified copy of your divorce decree and make sure that it says you are not responsible for taxes after that date.

The only problem I foresee is that the taxes in question might be for the previous year — in which you were still married, and thus legally responsible. I hope that’s not the case. And if they say that, then you need a tax attorney in Illinois.
