Wills Outdated?
The witnesses on our wills are all deceased. Is our wills still good? We live in the state of Florida.
Terry Says
That would only matter if the wills were contested by your heirs, and not likely to make a difference. But don’t you think it’s time to UPDATE your will — or maybe create a revocable living trust?
Surely, things have changed in the intervening years if your witnesses have died. Certainly estate law has changed, so some provisions might need to be updated. Your children might have been young when your will was created, and at that point could not inherit. By now they may be adults — and you may want to direct specific assets to each of them.
This is not a do-it-yourself project. Work with an estate planning attorney in your state. Find one by asking your bank trust department. Or use this website: https://search-attorneys.com/
