Divorce and ex’s SS
Hi Terry,
I have been divorced for 26 years. I was married for 16 years. One son. (36 years old now) Am I able to receive any social security funds from my former husband? How can I find out if he is taking Social Security now? Do I need to wait until he takes social security? I am unsure if he has retired. Thank you for your help.

If you were married for 10 years, and are not currently remarried, and are at least age 60, you can qualify for benefits on your ex-spouse’s return. You are entitled to half of his — or yours — whichever is larger.
You should wait until YOUR full retirement age to collect so your benefits are not reduced. It does not matter if he is collecting. But you’ll need his SS number so they can let you know which is the larger benefit.
