Is there an answer Dad is 78 yr old son is self employed and not making it at 51 yr old Can dad who is paying his rent and food declare him as a dependent This has been going on for eight years HELP?

Terry Says

I’m not sure whether this would stand up to IRS scrutiny — but if it has been going on for 8 years, you’re likely to find out. The law says that anyone who contributes more than 50% of the support for another person, can take him as a dependent. But the dependent can prevent that by simply checking on the box that he is NOT eligible to be declared as a dependent on someone else’s return.
Then if the father continues to claim the son, while the son files independently, there will definitely be a contact from the IRS. Best to work this out privately.
