Ask Terry Questions changing a name on the deed to my house

changing a name on the deed to my house

By Terry Savage on October 25, 2026 | Financial Planning / Retirement

My husband passed away 8 years ago I never removed his name from the deed to the house. I currently do not have a will…working on that…but I want to know how I can change the deed and put my brother on it. this way the house is his should something happen to me. However one caveat, my brother is on disability and i want to know if having his name on the deed will have a negative effect on his disability benefits.
thank you for your time.

Whoa – you need more advice than a quick Q&A. You definitely don’t want to complicate your brother’s life (or your own) by putting his name on the deed.

What you really should do is create a Revocable Living Trust as your estate plan. Then name a successor trustee to handle your property at your death, with instructions to keep moneyout of your brother’s name, but to make sure he is well cared for. You need a good estate planning attorney to do this for you. So don’t just be “working on it” re your estate plan.
