Disabled adult claimed as dependant in 2018 but situation changed for 2019

By Terry Savage on April 24, 2020 | Wild Card

I am a 36 year old who receives social Security disability and SSI, and I have since I was 19. Last year, I was engaged and living with my fiance who claimed me as a dependent on his 2018 taxes. In May of last year we broke up and moved back to Illinois from Georgia and went our separate ways. So my question is, since I’m disabled and not usually required to file taxes and was claimed as a dependent in 2018,will I receive my stimulas payment? I received a SSA1040 (I believe that’s what the end of the year statement is called) for 2019 at my current mailing address and I receive my monthly benifts via Direct Express debit card.(Which I know there are still many questions surrounding deposit dates for Direct Express card holders, but first things first, I want to be sure I am eligible.) I haven’t filed anything on the IRS free filer or Non-filers tool since I receive SSDI and have Direct Express. But I’m starting to get concerned about my eligibility simply because I was claimed as a dependent in 2018 and have been informed that the taxpayer who claimed me has yet to file his 2019 taxes. However I know that he will be dropping his documents off to his tax preparer on Tuesday. But if HIS eligibility is going to be based off of his 2018 return,I’m concerned that will make me ineligible for the stimulus payment. Even though my living situation is completely different than it was in 2018. I have been hoping, since I do receive that SSA “tax” form, and the SSA is sharing info with the IRS in order to ensure recipients receive their payment, that the decision would be based off of my 2019 SSA form. I’m afraid that I am just going to have to do what I have been doing, which is trying to patiently wait and hope that the $1,200 will come via direct deposit to my Direct Express card come end of April like I have read it’s supposed to be the approximate deposit dates for SSDI recipients receive their monthly benefits via Direct Express debit card. Of course, once I determine that’s I will indeed receive the payment, the exact date of when it will become available on Direct Express is still question. And even more questions in my particular situation since I don’t receive strictly SSDI. I also receive SSI. I don’t have any dependents under the age of 17 so that’s one thing that I don’t have to add to my already complicated situation. So any information surrounding any of the topics I have discussed would be greatly appreciated.

I think you’ve assessed the situation exactly correctly. It’s a shame that he didn’t file his 2019 taxes earlier, when they would have a better chance of recognizing that you are no longer a dependent on his return.
I think (based on the deadline) for SSI recipients to register their dependents, that they are going to start going through this group in the next few weeks. The very first thing they do is run the SS numbers of SSI (or SSDI) recipients through the system to see if they are claimed as dependents on another return.

So it’s going to be very close, depending on whether he files his return for 2019 electronically and ASAP. Urge him to do that — or you will be out of luck if they find your SS on his 2018 return.

And you won’t know for at least four weeks from now. One small hope, there may be a “dispute resolution” put in place for people in situations like yours. But that could take months!
So sorry to give you this bad news.
