Divorced with restraining order

By Terry Savage on May 08, 2020 | Wild Card

How do I get a transcript of my ex husband’s tax return from 2019 to get my AGI? He filed taxes without my consent, signature or earned income for that year and I don’t have the account number for the direct deposit or anything to verify my identity. We have a no contact order until 2021 so I can’t ask for a copy of the taxes from him or his accountant. IRS isn’t sending transcripts in the mail now. What are my options?

The first step would be to contact your former divorce attorney and ask him/her to demand a copy of the return. Or you can try to contact the clerk of court to petition the judge directly to issue such an order. It’s worth a try. But I will ask the IRS media person with whom I am in contact to give me an opinion. He ducks most specific questions, so I assume he will tell you to wait until the IRS office reopen in coming months.

I will tell you one thing: It is a FEDERAL CRIME to falsify a return (adding your signature, even though you were married at the time — and especially if you were divorced at year-end. It is also a FEDERAL CRIME to interfere with a stimulus payment!

I would suggest you send him a link to this post. You might agree to not file a complaint with the IRS which would initiate an IRS investigation — IF he gives you your $1200 stimulus payment!!!
