Ask Terry Questions Estate Planning

Estate Planning

If the Executor of my estate is also a beneficiary, how can I ensure that Executor doesn’t deplete the estate by taking the assets he’s entitled to, immediately after my death?

Terry Says

Executors must act at the direction of the court, putting a will through the process of distribution. But the answer is to only name an executor whom you trust!
Did you consider creating a Revocable Living Trust and naming a successor trustee to pass your assets per your directions — either when you die, or if you become incapacitated.
It’s time to talk to an estate planning attorney who specializes in these issues.
