Ex-spouses social security

By Terry Savage on February 23, 2022 |

I’ve been divorced for 6 years. Currently I am 71, male & retired, and my ex is 58, still working. Is there a way l can claim anything from her social security? There is no financial terms from our divorce, such as alimony etc. When we divorced she kept ALL of our investments and the house. My situation was so bleak l filed Chapter 7 three years ago.

You can claim on her record — IF the benefits would be larger than your own. You can qualify for 50% of her benefit — assuming you were married for at least 10 years.
But if you claim before full your full retirement age, your benefits on her record will be reduced.
And that assumes that half of her benefits would be larger than your own.
