Home ownership
Sister-in-law and ex- are both on title of their Indiana home. Only he is on the mortgage.
They have been living together for years because the ex-hubby will not/cannot refi and pay her off. She doesn’t want to sign a suit claim deed without getting some money from him. Is there any legal way she can get out of this arrangement with funds?
Terry Says
She needs a civil attorney (not divorce) in the state of Indiana, to force the sale of the home. That should have been done at the time of the divorce when she had some leverage. She shouldn’t sign anything without the advice of an attorney familiar with real estate law in Indiana. They are basically two people who own a property jointly. But assuming the deed is in joint name with rights of survivorship, she will get the entire thing if she outlives him! And vice versa!
