IRS Refund/Stimulus of Deceased Spouse
I filed my taxes electronically on April 15 – not a complicated return. I still have not received my direct deposit refund and have gotten no updates on the IRS2GO app. I heard something recently about people getting stimulus payments for deceased people. My husband died on January 15. I did receive a direct deposit stimulus payment of $2,900 (I have a 15 year old son). Since I am unable to talk directly to anyone at the IRS, I am asking you for help. Do you think that I need to write a check to the IRS for my husband’s share of the stimulus, and that would help me to get my refund?

This is very much up in the air — and I would wait til it is resolved, probably in the courts. Treasury Secty Mnuchin made an offhand remark that dead people’s stimulus checks should be returned. That sent the IRS scrambling. In fact, they had actually made out checks noting the payee is “deceased.” So the IRS issued a statement telling people to return the checks. Immediately afterward, legal experts said they had no grounds to do that, because the CARES act specifically forbids
“clawbacks” in case of error. And the act also said the payments would go to anyone who filed a return in 2018 or 2019. So I have a feeling this will go to court to be determined!
