medicaid support for nursing home care

By Terry Savage on October 12, 2025 | Financial Planning / Retirement

My sister’s husband had a stroke and is in a nursing home. They are both retired but do not have a lot of money. He will be on medicaid in a year and a half. We are in Illinois. She is going to sell the house and move near me to be close to family for help with his care. Do we need a lawyer to advise us on what to do. She does have POA for healthcare and finances. Myself and my other two sisters want to protect her if we can.

Well, this is a bit complicated. If she sells the house, and it is in joint name, then half the proceeds would be considered his, and must be applied to his care before Medicaid takes over.
Yes, I think at this point you do need an elder care attorney to review the entire situation how everything is titled, powers of attorney, and a simple estate plan.
In Illinois I always recommend Kerry Peck, elder law expert: https://www.peckritchey.com/
