Ask Terry Questions pension and ex spouse’s social security

pension and ex spouse’s social security

By Terry Savage on January 23, 2025 | Social Security

I earn a government pension. Would I qualify for half of my ex’s social security she earned while we were married for 35 years? Thanks!

Terry Says

Under the new Fairness Act, you would qualify for half her benefits, assuming that amount was larger than your own. That presumes you are age 62, and are not currently remarried.
