Ask Terry Questions power of attorney

power of attorney

By Terry Savage on March 09, 2026 | Financial Planning / Retirement

Is it necessary to consult a lawyer to add Power of ATTORNEY to my existing trust? My bank has a copy of the trust. Can I simply add that new name to that copy? I am now 96.

Terry Says

You need an attorney to change your trustee, or add a “successor trustee.” But if you are talking about a healthcare power of attorney, you don’t need a lawyer for that. If you’re talking about a “business power of attorney” then yes consult your lawyer so it coincides with the trust.
