Will my husband’s adult children from his first marriage be able to claim a portion of a home that we buy together titled to us with right of survivorship to me should he predecease me?

Terry Says

No– BUT! This is the time for each of you to make new wills or living trusts, working together so they are complementary. Property titled in joint name (JTWROS) automatically passes to the survivor. So that shouldn’t be an issue. But if you want to keep your adult children happy, you probably want to assure they that they will each get some share of your separate wealth.
