My brother passed away on July 2, 2025. I received a Social Security check for June but the bank sent it back. I talked to Social Security and they said because he had no spouse. I’ve lived with my brother for 35 years and took care of him. Social Security said the only way to get the money as if someone is the executor of the of his estate.
He really has no Estate cause he passed with nothing. I’m afraid to become the executor of his estate because I do not want to be liable for his hospital bills. Can they do that to me? Just wondering if I can get that Social Security money back Thank you. I apologize if you receive this a couple times cause it didn’t seem like it went through.

No, you can’t get the SS money back. And SS stops retroactively from the month of death.
ALSO, there is NO provision for caretakers or relatives (other than a surviving spouse, or dependent children or dependent parents) to get any benefit from SS after death.

If he passed with no estate, other than personal effects, there is no need for an executor — since this estate will not go through the probate process.
