Ask Terry Questions Social Security

Social Security

By Terry Savage on December 29, 2024 | Wild Card

I was married for 20 years then divorced and not remarried. I receive a teacher pension. Given the fact that the Social Security Fairness Act has passed, am I entitled to some of my former husband’s social security pension?

Terry Says

Since you were married for more than 10 years, your benefit (assuming you wait until YOUR full retirement age to claim it) is HALF of your ex-spouse’s benefit.
You didn’t say whether you are already receiving a reduced benefit. If so, your full allowed benefit should start in 2025. But they need to reprogram their computers — a huge task!
