Ask Terry Questions Social Security Fairness Act

Social Security Fairness Act

By Terry Savage on January 05, 2025 | Wild Card

Thank you for all the information on this topic. My questeion pertains to surving spouse benefit of SS. My wife was a teacher for 32 years and also worked before and after her career on salaries that paid into SS for her 40 qtrs. so she has had her SS reduced by 2/3 due to her TRS pension.
My SS is not altered by this due to my profession that was not included in the WEP so I get the full amount due to me.
Question is will she be eligible to get my SS if I pass first with this new Act?
She was not eligible before this Act was our understanding.

Terry Says

After the new act is signed into law, if you pass first she will be entitled to the larger of her own earned benefit (without reductions) OR your benefit — whichever is larger.
