Ask Terry Questions Social Security Fairness Act

Social Security Fairness Act

By Terry Savage on January 06, 2025 | Wild Card

Terry:
I am a retired public school teacher with a pension. I have a couple of quarters of work that paid into Social Security – no where near qualifying for a ss benefit. My husband of 30+ years died four years ago. At that time I was told by a ss employee that I did qualify for a spousal benefit, but it would be $0 because of my pension. My questions- With the passage of the Social Security Fairness Act would I now be entitled to some kind of spousal benefit from my husband’s social security? If yes, how would I go about getting it?

Thanks for any help you could give me.

Terry Says

YES. You will be entitled to your husband’s full benefit at death. We will have to wait to see how/when SS will reorganize itself to start paying these benefits.
