Ask Terry Questions Spousal benefit under Fairness Act

Spousal benefit under Fairness Act

By Terry Savage on September 16, 2025 | Social Security

I received a substantial increase in my SS check due to the Fairness Act. I was reading that I should apply for spousal benefits. My wife’s SS benefit is much more than mine. I applied via a telephone interview with my local office and will be receiving a little bit more money, plus a retroactive check. What are your thoughts? I think you had some reservations about this.

Terry Says

You are entitled to the larger of your check — OR half of your wife’s benefit –if you have been married more than 9 months and both of you are alive.
I suggest that before your meeting you should determine the actual correct amounts.
Do that by going to MaximizeMySocialSecurity.com.

Don’t count on SS to do the correct calculation.
