SS rules for ex-spouses

By Terry Savage on July 05, 2025 | Social Security

Hello Terry, If someone wants to receive their ex-spouse’s SS benefits, does that ex-spouse have to already be receiving their own SS benefits? Yes to all, married for over ten years, neither remarried, both over 62 years of age. It is unclear who’s benefits are greater, at this point. Is it also clear, that ex-spousal benefits have no affect upon one’s own SS benefits whatsoever? I so appreciate your time and effort. Thank You, from a Long Time Listener

Terry Says

Your ex-spouse does not have to be collecting for your to qualify in your situation. BUT, you do not want to make an expensive mistake, that locks you into lower benefits for life.
Please go to www.MaximizeMySocialsecurity.com and pay the $49 to get the correct claiming strategy — based on your work record and that of your spouse.

And do not count on a SS rep to give you the correct advice!
