Ask Terry Questions Stimulus Check-Emancipated Minor

Stimulus Check-Emancipated Minor

By Terry Savage on January 23, 2021 | Wild Card

We have a son who became an emancipated minor in January of this year. He moved into his own apartment in May of 2020. He made $19,000 this year and will be filing independently. $500 and $600 were included in our stimulus checks in 2020/2021 because he was filed independent and age 16 in 2019 taxes.

When filing his taxes (H & R Block Premium tax program), it is giving him an $1800 stimulus check because he has to answer the “Did you receive a stimulus check?” as no. If answering yes, it asks for the numbers from the IRS 1444 form to show how much he received.

Is he supposed to receive the check? Do we need to somehow “repay” the $1100 that we received from “child” additions to our checks? How do we report it or get it corrected? Thanks for any help you can offer.

That’s an interesting question. I will ask the IRS, but technically he is NOW entitled to file for HIS OWN stimulus based on 2020 income — and that covers the original one and the new $600 one. HE did not receive the original stimulus checks — you did! And if they ever get around to cross-matching the SS numbers, theoretically they could ask you to give the money back — but likely they won’t get there!
