Hi Terry, I was wondering, my husband passed away , October 12, 2020 , what happens if $1200.00 gets deposited into our account do I have to send $600.00 back since he passed away. Everyone is telling me something different, I am so very confused.

The legislation for the Cares Act — the first stimulus — left this issue very much in doubt. The IRS not only sent checks to people who were deceased, but often it sent them payable to “the Estate of the deceased”! That happened until the Treasury Secty threw a fit. Then the IRS asked for the money back. But many attorneys and consumer advocates said the original legislation clearly said that anyone alive at the end of 2018 qualified for the stimulus check! Most people deposited the checks and are waiting for the IRS to personally ask for the money back!!

We will have to see how this new round of legislation — just passed, and not yet signed by the President, will deal with this issue. I’m betting they included some instructions about situations like yours. So I can’t give you an answer beyond, wait and see if you get a check. And at that point you can deposit it and wait for instructins.
