stimulus check made out to my deceased mom and I.

I received a stimulus check made out to my deceased mom and myself. Do I have to send it back or not. I just saw on the IRS website that Steve Mnuchin said all checks made out to deceased must go back. Just want to do the right thing.

There is a great debate over whether the IRS has the authority to reclaim these checks, or request you return them! This all started last week when the Treasury Secty demanded people return checks of the deceased — despite the fact that many had the word “deceased” in the payee line.
Here’a link to an article describing the situation. Make your own decision, but it is unlikely that any benefits will be clawed back because of a provision in the Cares Act prohibiting clawbacks.
