Taxes during divorce and pandemic benefits

My husband and I decided last year to get divorced, and myself and our son moved into an apartment in July 2020. The divorce paperwork has not been filed, and he (like all previous years) would be filing as married, and the refund we set aside for our son’s school/misc. expenses throughout the year. I have been receiving some benefits from the state for food only, since August 2020. Is that something I need to tell him about so he can file appropriately, or can I keep that information to myself? The mandated benefits were around $40 per month, but I started receiving extra I’m assuming because of Covid relief, and those payments were around $300. Thank you so much for your knowledge and help!

I don’t think you have to be concerned about telling him about that. Yes, legally you should. BUT you can say you didn’t know, given the circumstances. What concerns me more is that if he declares YOU on his tax return, he will get a $600 second stimulus for you — and if your son is under 17, he will collect the same $600 for your son (assuming your joint income on that return is under $150,000. so instead of worrying about helping him get his tax records straight, you should be demanding BOTH stimulus checks — a total of $1200 that he likely just received!
