As part of my divorce process, I employed Delphi consulting Group of Port Washington, WI to do a valuation of my husband’s annuity through US OPM. When he retired, I received much less than was indicated in the valuation. I contacted Jesse Mueller of the firm and he agreed. So I requested an accounting or breakdown of data to determine the annuity amount. I have emailed and faxed over 20 times and receive no reply. What can I do?

Whew — once you’re divorced it’s difficult to re-open a settlement — Did you get a QDRO order (qualified domestic relations order) specifing the exact percentage of his payout that you were to receive, or a specific monthly amount based on the projections?
The only way to pursue this is to have your attorney engage the services of the consultant — and file an ERISA action against the government! And that would be a very long shot! (ERISA is the government’s own law, protecting pension rights.)
Another avenue might be the Consumer Financial Protection Bureau.
But you need specifics of their “error” in payout, as well as the legal order that requires them to pay a specific amount or percentage.
