Where to find missing investments in divorce

By Terry Savage on January 21, 2023 | Wild Card

Hello Terry
My husband recently filed for divorce. I’m unable to find much of the investments, retirement accounts. Is there a way for me to find them?
Thank you for your time.

First, you need a good lawyer –one who is on YOUR side, and not just “running the meter.”
Second, if you signed joint tax returns, all the information is there– and you are entitled to a copy of those returns.
Your lawyer will ask for them. They will show any dividends from stocks, and any capital gains from mutual funds (letting you know which brokerage firm holds those accounts), and any interest from bank accounts.
Your husband will be required by law to disclose all his assets, and your lawyer will learn this in “discovery” if he is not making it all available to you. Retirement funds are “his” assets, but a good divorce attorney might be able to get you a set-aside from them or from a pension.

Im sure you feel betrayed and emotionally battered, but it is good that you’re gathering all the facts. If you live in Chicago and need a recommendation for an attorney send me an email.
