Wills & Power of Attorney for Health Care

By Terry Savage on August 08, 2025 | Financial Planning / Retirement

Hi Terry, How do we start doing a will. I know if my husband dies before I do I would be the Executor If I die first he would be the Executor. Would we be able to name our daughter who is almost 38 yrs old an Executor if she is living in Japan? She has been in Japan cause she is teaching English in Japan. I would not know who to use as a Executor if my daughter living in Japan can’t do it cause she’s not living in the United States. We don’t have any other family members that we could name as an Executor.

Not sure how to start a will. Can we use Will & Trust as seen on TV? Do we need a Lawyer for this also? Not sure who to use, Also,My Husband’s doctor and my doctor gave us papers for Power Of Attorney for Health Care. How do we get a Lawyer for this? Can I be my husband’s Power of Attorney and he be my Power of Attorney? Do we have to get a Will or Power of Attorney Notarized? Not sure how to do these things. Thank You for your help.

Terry Says

OK, first complete those healthcare powers of attorney. Depending on your state, they do not have to be notarized. Ask your physician if your state requires a notary. Do that first thing.
