Workman’s Comp and Unemployment
I am a nurse who injured his back lifting a patient, on the job, in September of 2019. The company put me on Workman’s comp and gave me some back treatments (which did nothing) until December. Then they moved me to an administrative job, which lasted only a couple weeks, because the back injury prevented me from sitting in one position for eight hours a day. So I have been unemployed since Feb. 7th, 2020.
I got an attorney who has brought suit, and in a couple months I may be getting a settlement from the hospital.
In the mean time, I have been on unemployment since mid-June. But I just noticed a question on the unemployment certification asks if I am getting or about to get a workman’s comp payout.
I don’t know if my lawsuit is considered a workman’s comp payout, and since I don’t have it yet, I don’t know if I need to stop making unemployment claims. The hospital ended all workman’s comp payments and medical treatments back in December, 2019.
What should I do?

Keep certifying. You are unemployed and you are NOT receiving workman’s comp, and you don’t know if you will get a settlement. Certify– that’s what unemployment is for!
