Back due taxes and eligibiity for stimulus

By Terry Savage on April 08, 2020 | Wild Card

Due to divorce several years ago my refunds have been garnished due to ex’s back due taxes (and as a result I haven’t filed in many years). Will I still be eligible for the stimulus? (although it was declared in my divorce that he was liable for all debt) and if I file, will I receive a return?

Even if you owe back taxes, you are eligible for a stimulus check. But you’ll need to register if you haven’t filed taxes. Use this link to register: https://turbotax.intuit.com/stimulus-check/

And, as an aside, you should go to legal aid when things calm down. If it was written in your divorce decree that he was liable for back taxes, even though you signed the returns, you might be able to negotiate with the IRS as a “hardship case” to receive any tax credits owed to you. I’m assuming you didn’t have enough income to file during those years, and assumed you wouldn’t get any child credits or other credits that you would otherwise would have received.
