Simulus checks, child support, and current spouse of non custodial

By Terry Savage on April 10, 2020 | Wild Card

I’ve seen the question asked a few times, but not in a scenario like this:
Person A. is married to Person B. with 2 children eligible for stimulus checks. Person A. made the income, B. has been a stay at home parent last 3 years. They filed jointly. Person A. will lose check for back child support to Person C, Would the children and Person B. have their checks taken as well?

Terry Says

I have specifically asked the IRS that question, and they haven’t given me a response yet. The way the law is worded, person B who filed on the joint return, is supposed to get his/her individual check, and the couple should get $500 for each child under age 17. I’m waiting for the Treasury/IRA to spell that out clearly. Please check back at my website after this holiday weekend. I’ll make it a headline either way!
