Ask Terry Questions stimulus check for deceased

stimulus check for deceased

My deceased aunt received direct deposit of $1200 How do I return it?

Terry Says

This is a tough one. The IRS belatedly (after making payments to many deceased, even putting the word “deceased” in the payee line) issued instructions on 5/5 that those checks are supposed to be returned.

However many tax experts have opined that the IRS doesn’t have the authority to “claw back” these payments, and that in any case they were legally made because they went per the law to those who filed a 2018 or 2019 return! This might be challenged in the courts, so you might want to wait for the outcome.
