Ask Terry Questions Stimulus check for prison inmate

Stimulus check for prison inmate

By Terry Savage on November 30, 2020 | Wild Card

I have heard you on WGN radio. A stimulus check came by mail to my son who is in prison. Can I deposit it in his bank account or should I return it.

Terry Says

If he filed a tax return in 2018 and qualified based on income, he gets to keep the stimulus check. Deposit it into his account. there has been some back and forth in the courts, including a class action suite in California over this, but for now for now the agency’s website acknowledges the ruling that “the IRS cannot deny a payment to someone who is incarcerated if they meet the criteria.”
