Deceased/grandkids
My husband and I lost our only child in 2023, he was 30 years of age. He had 2 babies. He was just newly divorced 2 months before his death. We took his ex wife to court to see our grandchildren, it took 2 years to get an answer, this was in Indiana and cost us a fortune. The judge decided with the mother, it fathoms me how one person can believe so many lies. During the court waiting on decision, the mother re married and she kept her maiden name and the kids got her new husbands last name.
My question is when we pass, and I’m stage 4. Does our estate go to the children or his ex wife? She does have control of my son’s estate. She lied to me about all that. She went to court the week after he passed.
How do we keep her name off our estate, money , house? When we pass. Will a Will help us, stating her name and kids names off our estate.
She will take the kids money. And they have money coming to them once their of age from the semi that pulled out in front of our son. The mother has already took money out of their funds due to court records.
I also have one other question. My husband is retired and I was always a stay at home mom. But once my son had graduated. I couldn’t work due to health issues. I need a liver transplant, and I don’t understand why I can get disability.

Oh my God. That is a HORRIBLE story. The first thing you need is a good estate planning attorney — someone who works in your state of residence. You’ll need to create separate trusts for your grandchildren, with an independent trustee to invest and distribute the money according to your instructions. For example, you might direct the trustee to pay a certain amount, maybe 10%, to them at age 21, then more at age 25, and the balance at age 30.

As for your disability, are you already on Social Security? And Medicare? I’d need to know more about your situation to answer that part.
