Why wouldn’t a hospital be aware of the potential insurance issue between admittance and observation and act accordingly?

They ARE aware. But they count on the fact that YOU are not aware! Not admitting you gives them flexibility, so if they send you home and you come back it does not count against them as a “re-admission.”
