Ask Terry Questions Soc. Security Fairness Act

Soc. Security Fairness Act

By Terry Savage on March 09, 2025 | Social Security

Hi Terry,
I am a retired teacher. Lost my husband of 22 years in 2020, he was 56. He paid into SS since he was a teenager. I took my SS at 62. I was getting $110 ( roughly ) monthly.

My question: with the new Fairness act that passed. Can I forego my SS and draw on his , since it will be substantially higher in pay?

Thank you,

Terry Says

Yes, you should receive the higher of the two benefits. But go to www.MaximizeMySocialSecurity.com and do the calculations there to make sure you are getting the right amount. It is worth the $50 fee to be educated BEFORE you call SS! (And that’s assuming anyone will be there to answer the call!)
