Social security Fairness Act
My wife has an Illinois teacher’s pension. She never applied for Social Security benefits because we knew she would not qualify. As a result of the Fairness Act, she enrolled for SSA benefits about 2 weeks and will begin receiving spousal benefits next month. The SSA rep she talked to said she did not qualify for retroactive payments because she had not enrolled earlier; that payments can only be paid retroactively from the date of enrollment. Listening to you on WGN, this didn’t sound correct, so she called back to get a clarification. The agent she talked to said since the case was already filed, she would need to appeal the ruling to get the filing changed. Does this make sense? Should we appeal? Thank you for your help

Nothing makes sense! That is not the way I understood it. The law says, retroactive to Jan 2024.
But they are running wild there now — reinstating 100% clawbacks.
If I were you, or her, I would just be grateful to get anything at all!! And not make waves!
And, yes, it pains me to say this.
