Stimulus check for deceased family member
Hi, I try to listen when you are on WGN radio and I may have missed it if you have already given a definitive answer to the question about the stimulus checks sent to deceased family members (actually, the check had my name on it as well as my mother’s with “deceased” after her name). I cashed the check, but I am afraid to spend the money, if I have to pay it back. I know at first you said it would not have to be paid back and then I heard it might be. Do you have a final answer?
Thank you!

The IRS says it is going to ask for that money back. But the law says there cannot be clawbacks! So we will see how it works out. In the meantime, many banks are now refusing to accept stimulus deposits to the account of the deceased! So you have to mail it back.
Here’s an interesting article on the subject.
If you’ve already deposited the money it will be difficult to send back. So let’s see how this works out. Maybe when you file your tax return next year, you’ll have to declare the overpayment.
