Ask Terry Questions Will vs. Trusts

Will vs. Trusts

By Terry Savage on April 22, 2025 | Financial Planning / Retirement

My attorney says I don’t need to put my home in a trust but instead can attach a T.O.D.I. to it with my children as beneficiaries in my Will.
I’m told that will avoid probate.
Your thoughts on that.
Thank You

Note especially that if the house is named in a trust and you are alive but incompetent (think stroke or dementia) your named successor trustee can make decisions such as selling the house to provide care for you.
