Medicare trusts for disabled

By Terry Savage on August 21, 2022 | Wild Card

Terry desperate for info. My brother was hit by drunk driver still in hospital and rehab centers for nearly 11 months. Laywer said he needs to go on Medicare. Told him to sell assets to qualify by giving it to family members. Doesn’t sound right to me. Opinion?

Wrong lawyer! Leave the lawsuits to him or her — that’s likely their specialty.. And I hope you collect.
There are many good attorneys who specialize in getting payments for people who have been disabled by drunk drivers. Here’s one I found: https://libertyvillepersonalinjurylawyer.com/bogdan-martinovich-offers-assistance-victims-drunk-drivers/

But typically these attorneys don’t specialize in working with the finances of the disabled before they win a lawsuit.
Let’s start with Medicare (vs Medicaid). If he is permanently disabled he will qualify for Medicare Disability insurance. Learn about that here. There is NO INCOME QUALIFICATION for Medicare for the disabled.

I think the lawyer you quoted is talking about MedicAID — the state program that covers healthcare costs for impoverished individuals. But there is a law against transferring assets to qualify for Medicaid — and a five year look-back period to make sure that doesn’t happen.

You need an attorney who can help him through this jungle. I’d recommend starting with Kerry Peck at (855) 328-5787. They may be able to advise you on how to deal with preserving assets such as his home, while still qualifying for other benefits.
